1. Scope of Services
This section defines exactly what you are being hired to do—and what you are not doing.
What is included:* Reviewing documents, preparing application packages, submitting files to relevant immigration authorities, and providing updates.
What is excluded:* The consultancy does not provide general legal advice outside of immigration matters, nor does it guarantee employment or housing in the destination country.
2. No Guarantee of Outcomes
This is the most critical clause for an immigration consultant. You cannot control government decisions.
> Important Notice: The Client acknowledges that [Company Name] has no control over government processing times, policy changes, or the ultimate decision of the immigration authorities. Approval or rejection of any visa, permit, or citizenship application rests solely with the respective government body. No refunds will be issued based on an unfavorable government decision.
3. Client Obligations and Accuracy of Information
The success of an application relies heavily on the client. Put the responsibility of truthfulness on them.
Honesty: The client must provide 100% accurate, authentic, and truthful information and documents.
Consequences of Fraud: Any misrepresentation, forged documents, or withheld information will result in immediate termination of services without a refund, and the consultancy will not be held liable for any resulting government bans or penalties.
Timeliness: The client must provide requested documents within specified deadlines to avoid application delays.
4. Fees, Payments, and Retainers
Clearly map out how money is handled to avoid payment disputes.
Payment Structure: Outline whether fees are fixed, hourly, or split into milestones (e.g., 50% upfront, 50% upon submission).
Third-Party Fees: Explicitly state that government application fees, translation costs, medical exams, and police clearances are *not* included in your consulting fees and must be paid separately by the client.
Late Payments: State that work will halt immediately if invoices are overdue.
